DISCLAIMER AND LIMIT OF LIABILITY

Taxcolors and its affiliates (and service providers to taxcolors)

(a) disclaim all implied warranties and representations (e.g. Warranties of merchantability, fitness for a particular purpose, accuracy of data, information, views, advice, software, representation, and noninfringement);

(b) do not guarantee that the services will function without interruption or errors, and

(c) provide the service (including content and information) on an “as is” and “as available” basis.

However the above shall be subject to limitation under jurisdictional law which may not permit certain exclusion of warranty

Exclusion of liability

1. In particular, taxcolors and affiliates, and its licensors and its suppliers do not represent or warrant to you that:

1. Your use of the services will meet your requirements
2. The software, services, advice, opinion, data, information or any other material through our services whether by taxcolors, members or visitors shall be correct and provide you error free solutions
3. Your use of the services will be uninterrupted, timely, secure or free from error,
4. Any information obtained by you as a result of your use of the services will be accurate or reliable, and
5. That defects in the operation or functionality of any software provided to you as part of the services will be corrected.
6. That calculation of tax liability or other calculations shall be correct and error free

2. Any material downloaded or otherwise obtained through the use of the services is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or other device or loss of data that results from the download of any such material.

3. No advice or information, whether oral or written, obtained by you from taxcolors or through or from the services shall create any warranty or claim not expressly stated in the terms. You are advised to confirm the same from your own sources before making use of the same in any manner.

Limitation of liability

Taxcolors and its affiliates (and service providers to taxcolors) shall not be liable to you or others for any direct, indirect, incidental, special, consequential or punitive damages, or any loss of data, opportunities, reputation, profits or revenues, related to the services including for the following:

A. Any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but not be limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, any loss of data suffered, cost of procurement of substitute goods or services, or other intangible loss;

B. Any loss or damage which may be incurred by you, including but not limited to loss or damage as a result of:

1. Any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the services;
2. Any changes which taxcolors may make to the services, or for any permanent or temporary cessation in the provision of the services (or any features within the services);
3. The deletion of, corruption of, or failure to store, any content and other communications data maintained or transmitted by or through your use of the services;
4. Your failure to provide taxcolors with accurate account information;
5. Your failure to keep your password or account details secure and confidential;

Still in extreme circumstances, in no event shall the liability of taxcolors and its affiliates (and service providers to taxcolors) exceed, in the aggregate for all claims, an amount that is the lesser of (a) three times the most recent monthly or yearly fee that you paid for a premium service, if any, or (b) Rs.5000/-.

This limitation of liability is part of the basis of the bargain between you and taxcolors and shall apply to all claims of liability (e.g. Warranty, tort, negligence, contract, law) and even if taxcolors or its affiliates has been told of the possibility of any such damage, and even if these remedies fail their essential purpose.

Termination

Both you and Taxcolors may terminate this Contract at any time with notice to the other. However no notice would be required by Taxcolors in circumstances where You violate the terms of the agreement. On termination, you lose the right to access or use the Services. However we may continue use and disclose contents and information prior to such termination and further neither any compensation shall be payable to you nor any amounts shall be refundable to you.

Applicable Law and Dispute Resolution

In the unlikely event if we end up in a legal dispute, Taxcolors and you agree that the same shall be subject to Jaipur (Rajasthan-India) Jurisdiction

Copyright & trademark contents

Full efforts have been made to keep the contents on the website generic and there is nothing in violation of copyright or trademark laws. Still if you come across any such content or material or information on the website which is in violation of any law for the time being in force, please communicate us at support@taxcolors.com and we will remove the same immediately if found so.

General Terms

The English language version of this Contract is binding. This Contract (including additional terms that may be provided by us when you engage with a feature of the Services) is the only agreement between us regarding the Services and supersedes all prior agreements for the Services, if any.

“DOS AND DON’TS”

Dos

You agree that you will:

1. Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, information technology laws, tax laws, and regulatory requirements;
2. Submit accurate information to us and keep it updated;
3. Use your real name and correct information in your profile; and
4. Use the Services in a professional and dignified manner.
5. Inform Taxcolors in case violation of any applicable law including copyright and trademark while using the website

Don’ts

You agree that you will not do any of the following:

1. Create a false identity on Taxcolors
2. Copy, use, disclose or distribute any data or information obtained from the Services, whether directly or through third parties
3. Use or support software, devices, scripts, robots, or any other means or processes to scrape the Services or otherwise copy profiles and other data from the Services
4. Use computerized or other methods to access the Services, add or download contacts, send or redirect messages
5. Posting software viruses, worms, or any other harmful code
6. Bypass any security feature or any access controls or use limits of the Service
7. Disclose information that you do not have the consent to disclose
8. Use abusive or unwarranted language while using services in any manner
9. Violate the intellectual property rights of Taxcolors & others, including copyrights, patents, trademarks, trade secrets, or other proprietary rights.
10. Attempt to derive the source code for the Services or any related technology that is not open source
11. Rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same
12. Monitor the Services’ availability, performance or functionality for any competitive purpose
13. Engage in mirroring or otherwise simulating the appearance or function of the Services
14. Modify or alter the Services or their appearance in any manner
15. Place an unreasonable load on the Services or Interfere with the operation
16. Act in a manner while using the services of Taxcolors so as to violate any law of the land
17. Violate any other policy.
